From WoTC:
So I think Leonard has to say whether to follow this ruling.
The orgininal PHB ruling is that
What I'm saying is, the new ruling is because of essentials which allows unlimited use of magic item daily power. But this is base on whether you use the Rarity/Uncommon/Common item schemes.
If you don't use the scheme, then game mechanics is abit broken in the sense that we can buy low level magic item and activate the daily power of the item.
There is another website which a DM has an interesting ruling:
4e Magic Item Use: A Compromise
Magic Item Usage
Before we bring this discussion to a close, it’s worth mentioning that the limits on using daily magic item powers are no longer part of the game. They existed to prevent the characters from stockpiling items that were far below their level but still had useful, daily powers. Under this scheme, such items are uncommon. Stockpiling a number of them is impossible without house rules or a Dungeon Master who willingly awards multiple copies of such items as treasure. With our new rarity scheme in place, we no longer need such rules.

The orgininal PHB ruling is that
A magic item’s daily power can be used once per day and is renewed when its user takes an extended rest. As with daily powers provided by your class, there is a limit to the number of magic item daily powers you can use on any given day. This limit
depends on your level.
At 1st–10th level, you can use one magic item daily power per day.
At 11th–20th level, you can use two magic item daily powers per day.
At 21st–30th level, you can use three magic item daily powers per day.

So, in order to appease both the game balance side and the game immersion side, I have come up with a compromise. ou can still use one magic item daily power use per tier, as usual. In addition, you can activate another daily power from a magic item, but at the cost of a healing surge. You are still restricted to only one such use per round and with all the usual limitations. This allows you to access more item powers each day, yet it still puts an overall limit to item usage.
